A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to applicability to military service members of minimum |
|
age policies imposed by commercial lodging establishments. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is |
|
amended by adding Chapter 114 to read as follows: |
|
CHAPTER 114. MINIMUM AGE POLICIES OF COMMERCIAL LODGING |
|
ESTABLISHMENTS |
|
Sec. 114.001. DEFINITIONS. In this chapter: |
|
(1) "Commercial lodging establishment" means a hotel, |
|
motel, inn, or similar entity that offers lodging to the public in |
|
exchange for compensation. |
|
(2) "Military service member" means a member of: |
|
(A) the armed forces of the United States; |
|
(B) the Texas National Guard or the National |
|
Guard of another state serving on active duty under an order of the |
|
president of the United States; |
|
(C) a reserve component of the armed forces of |
|
the United States who is on active duty under an order of the |
|
president of the United States; or |
|
(D) the Texas military forces serving on state |
|
active duty. |
|
Sec. 114.002. MINIMUM AGE POLICY FOR LODGING WAIVED FOR |
|
MILITARY SERVICE MEMBERS. A commercial lodging establishment that |
|
imposes a minimum age policy that denies or restricts lodging to |
|
individuals based on age shall waive that policy for a military |
|
service member who: |
|
(1) seeks to obtain lodging at the establishment; and |
|
(2) presents a valid military identification card. |
|
SECTION 2. This Act takes effect September 1, 2019. |
