A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to designating the Texas Division of Emergency Management |
|
as the state liaison to the United States Army Corps of Engineers. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 418, Government Code, is |
|
amended by adding Section 418.054 to read as follows: |
|
Sec. 418.054. LIAISON TO UNITED STATES ARMY CORPS OF |
|
ENGINEERS. (a) In this section, "corps of engineers" means the |
|
United States Army Corps of Engineers. |
|
(b) The division is the state liaison to the corps of |
|
engineers except as provided by Section 16.091, Water Code. |
|
(c) The division shall: |
|
(1) serve as a clearinghouse for monitoring: |
|
(A) federal appropriations for projects of the |
|
corps of engineers in this state; and |
|
(B) projects of the corps of engineers that are |
|
under construction in this state, including: |
|
(i) progress on the project and expected |
|
completion date; and |
|
(ii) the total cost of the project, the |
|
amount and due date of any local matching funds requirement, any |
|
interest being incurred on the local matching funds, and how the |
|
local sponsor of the project plans to pay the local matching funds |
|
requirement; |
|
(2) monitor studies being conducted in this state for |
|
potential corps of engineers projects and how much the total cost |
|
and local matching funds requirement would be for the project; |
|
(3) develop statewide standards and guidelines for |
|
complying with federal regulations and requirements for corps of |
|
engineers project procurement; and |
|
(4) act as a liaison between the corps of engineers, |
|
relevant state agencies, and local sponsors of projects to ensure |
|
efficient communication and consolidation of information relating |
|
to existing and potential projects. |
|
(d) This section may not be construed as making the division |
|
or this state responsible for any local matching funds requirement |
|
for a corps of engineers project. |
|
(e) The division may delegate any of its responsibilities |
|
and duties under this section to the Emergency Management Council, |
|
if appropriate. |
|
SECTION 2. This Act takes effect September 1, 2019. |
