A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of an owner of real property sold at a tax |
|
|
sale to transfer the owner's right of redemption to another person. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 34.21, Tax Code, is amended by adding |
|
|
Subsection (l) to read as follows: |
|
|
(l) An owner of real property who is entitled to redeem the |
|
|
property under this section may not transfer the owner's right of |
|
|
redemption to another person. Any instrument purporting to |
|
|
transfer the owner's right of redemption is void. |
|
|
SECTION 2. The change in law made by this Act does not |
|
|
affect a transfer of a property owner's right of redemption that |
|
|
occurred before the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
