A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the fee collected for a municipal solid waste permit |
|
application; increasing a fee. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 5.701, Water Code, is amended by adding |
|
Subsection (r) to read as follows: |
|
(r) The executive director shall charge a fee for filing a |
|
municipal solid waste permit application under Chapter 361, Health |
|
and Safety Code, in the amount of $5,000 plus the cost of required |
|
notice. Money collected under this subsection may only be used to |
|
inspect the facility or site used or proposed to be used to store, |
|
process, or dispose of municipal solid waste to confirm information |
|
included in the permit application. The inspection shall be |
|
conducted prior to the issuance of a permit. The commission by rule |
|
shall prescribe the kinds of information in a permit application |
|
that require confirmation under this subsection. The inspection |
|
shall include an investigation for any unique, site-specific |
|
conditions that are relevant to a determination regarding the |
|
suitability of the site for operation of a landfill. Application |
|
fees collected under this subsection shall be deposited to the |
|
credit of the waste management account. |
|
SECTION 2. The changes in law made by this Act apply only to |
|
an application for a permit authorization for a municipal solid |
|
waste facility that is filed with the Texas Commission on |
|
Environmental Quality on or after the effective date of this Act. |
|
An application for a permit for a municipal solid waste facility |
|
that is filed before the effective date of this Act is governed by |
|
the law in effect on the date of filing, and that law is continued in |
|
effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2019. |
