A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a prohibition on the application of certain pesticides |
|
|
at public school buildings and other facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1951.212(c), Occupations Code, is |
|
|
amended to read as follows: |
|
|
(c) The department shall include in standards adopted under |
|
|
this section a: |
|
|
(1) requirement to use the least toxic methods |
|
|
available to control pests, rodents, insects, and weeds; and |
|
|
(2) prohibition on the application of glyphosate or a |
|
|
neonicotinoid pesticide at a school building or other school |
|
|
district facility. |
|
|
SECTION 2. The Department of Agriculture shall adopt |
|
|
standards under Section 1951.212(c), Occupations Code, as amended |
|
|
by this Act, as soon as practicable after the effective date of this |
|
|
Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
