A BILL TO BE ENTITLED

AN ACT
|

|
relating to restrictions on municipal regulation in certain areas. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

|
SECTION 1. Chapter 229, Local Government Code, is amended |
|
|
by adding Subchapter Z to read as follows: |
|
|
SUBCHAPTER Z. MISCELLANEOUS PROVISIONS |
|
|
Sec. 229.901. RESTRICTION ON MUNICIPAL REGULATION IN |
|
|
CERTAIN AREAS. Notwithstanding any other law, in an area in which |
|
|
the residents are ineligible or have only limited eligibility to |
|
|
vote in municipal elections, a municipality may not regulate an |
|
|
activity or structure that is regulated by this state. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
