A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to taking sand, gravel, marl, shell, and mudshell from |
|
|
Texas rivers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 86, Parks and Wildlife Code, is amended |
|
|
by adding Section 86.01915 to read as follows: |
|
|
Sec. 86.01915. EXEMPTION FOR CERTAIN DISTRICTS. (a) This |
|
|
section applies only to a conservation and reclamation district |
|
|
created or operating under Section 59, Article XVI, Texas |
|
|
Constitution. |
|
|
(b) A district may take sand, gravel, marl, shell, or |
|
|
mudshell from any river or tributary to restore, maintain, or |
|
|
expand the capacity of the river and its tributaries to convey storm |
|
|
flows. |
|
|
(c) A district acting under this section is not required to: |
|
|
(1) obtain a permit or pay a fee to take sand, gravel, |
|
|
marl, shell, or mudshell under Subsection (b); or |
|
|
(2) purchase sand, gravel, marl, shell, or mudshell |
|
|
taken under Subsection (b). |
|
|
(d) A district acting under this section may deposit sand, |
|
|
gravel, marl, shell, or mudshell taken under Subsection (b) on |
|
|
private land. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
