A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to creating a criminal offense for making certain |
|
|
telemarketing calls to a telephone number published on the Texas |
|
|
no-call list. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 304, Business & Commerce |
|
|
Code, is amended by adding Section 304.260 to read as follows: |
|
|
Sec. 304.260. CRIMINAL PENALTY. (a) A person who violates |
|
|
Section 304.052 commits an offense. |
|
|
(b) An offense under this section is a Class B misdemeanor, |
|
|
except that the offense is a Class A misdemeanor if it is shown on |
|
|
the trial of the offense that the person has been previously |
|
|
convicted of an offense under this section. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
