A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the random drug testing of members of the legislature |
|
|
during a legislative session. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 571, Government Code, is |
|
|
amended by adding Section 571.080 to read as follows: |
|
|
Sec. 571.080. RANDOM DRUG TESTING OF LEGISLATORS. (a) In |
|
|
this section, "controlled substance" and "marihuana" have the |
|
|
meanings assigned by Chapter 481, Health and Safety Code. |
|
|
(b) The commission by rule shall establish a program to |
|
|
randomly test members of the legislature for the use of controlled |
|
|
substances and marihuana during a legislative session. The program |
|
|
must provide for the random, unannounced drug testing of each |
|
|
member at times determined by the commission during a legislative |
|
|
session. The commission shall post on the commission's Internet |
|
|
website the results of each drug test or, if applicable, a statement |
|
|
that the member refused to comply with the commission's request for |
|
|
drug testing. |
|
|
SECTION 2. Not later than January 1, 2020, the Texas Ethics |
|
|
Commission shall adopt rules as necessary to implement Section |
|
|
571.080, Government Code, as added by this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
