A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to violations of certain conditions of parole; creating a |
|
criminal offense. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 38, Penal Code, is amended by adding |
|
Section 38.112 to read as follows: |
|
Sec. 38.112. FAILURE TO COMPLY WITH CONDITION OF PAROLE. |
|
(a) A person who is on parole for an offense listed in Article |
|
42A.054(a), Code of Criminal Procedure, or for which the judgment |
|
contains an affirmative finding under Article 42A.054(c) or (d), |
|
Code of Criminal Procedure, commits an offense if the person is |
|
required as a condition of release on parole to: |
|
(1) obtain the permission of the Texas Department of |
|
Criminal Justice before changing addresses or provide notice to the |
|
department of the location of the new residence and the person |
|
knowingly fails to obtain the permission or provide the notice as |
|
required; or |
|
(2) report to a parole officer as defined by Section |
|
508.001, Government Code, and on two consecutive occasions the |
|
person knowingly fails to report as required. |
|
(b) An offense under this section is a state jail felony. |
|
SECTION 2. This Act takes effect September 1, 2019. |
