A JOINT RESOLUTION
|
|
proposing a constitutional amendment providing for the creation of |
|
the State Flood Plan Implementation Fund to assist in the financing |
|
of certain flood-related projects and the transfer to that fund of |
|
money from the economic stabilization fund. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article III, Texas Constitution, is amended by |
|
adding Section 49-d-14 to read as follows: |
|
Sec. 49-d-14. (a) The State Flood Plan Implementation Fund |
|
is created as a special fund in the state treasury outside the |
|
general revenue fund. |
|
(b) As provided by general law, money in the State Flood |
|
Plan Implementation Fund may be administered and used, without |
|
further appropriation, by the Texas Water Development Board or that |
|
board's successor in function to implement the state flood plan |
|
that is adopted as required by general law by the Texas Water |
|
Development Board or that board's successor in function and to fund |
|
flood control dam repair and maintenance projects administered by |
|
the State Soil and Water Conservation Board. |
|
(c) Separate accounts may be established in the State Flood |
|
Plan Implementation Fund as necessary to administer the fund or |
|
authorized projects. |
|
(d) On November 30, 2019, the amount of $1.2 billion is |
|
transferred from the economic stabilization fund to the credit of |
|
the State Flood Plan Implementation Fund. This subsection expires |
|
January 1, 2020. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 5, 2019. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment providing for the |
|
creation of the State Flood Plan Implementation Fund to assist in |
|
the financing of certain flood-related projects and the transfer to |
|
that fund of money from the economic stabilization fund." |
