A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment prohibiting the taking of |
|
|
property by eminent domain for the purpose of transferring the |
|
|
property to a private entity. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 17(b), Article I, Texas Constitution, is |
|
|
amended to read as follows: |
|
|
(b) In this section, "public use" does not include the |
|
|
taking of property under Subsection (a) of this section for |
|
|
transfer to a private entity [for the primary purpose of economic
|
|
|
development or enhancement of tax revenues]. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 5, 2019. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment prohibiting the taking |
|
|
of property by eminent domain for the purpose of transferring the |
|
|
property to a private entity." |
