JOINT RESOLUTION
|
|
|
proposing a constitutional amendment protecting the right to earn a |
|
|
living free from unnecessary government interference. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article I, Texas Constitution, is amended by |
|
|
adding Section 35 to read as follows: |
|
|
Sec. 35. No governmental action establishing or enforcing |
|
|
requirements for, imposing or enforcing restrictions on, or |
|
|
otherwise regulating the business activity of an occupation or |
|
|
profession may impose a substantial burden on an individual's right |
|
|
to engage in a lawful occupation or profession unless the burden is |
|
|
necessary and narrowly tailored to protect against actual and |
|
|
specific harm to the public health or safety. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 5, 2019. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment protecting the right to |
|
|
earn a living free from unnecessary government interference." |
