No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to allow for exception to the application of a Class A or Class C misdemeanor offense for certain behaviors involving drug paraphernalia when performed by specific persons involved with certain programs established by law to prevent the spread of disease.

This analysis assumes the provisions of the bill addressing sanctions for criminal offenses would not result in a significant fiscal impact to the state and state correctional agencies.
