March 19, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB243 by Farrar (Relating to the promotion of breast-feeding and the prohibition against interference with or restriction of the right to breast-feed; creating a civil action.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require each state agency to develop a policy supporting the practice of worksite breast-feeding. The bill would require the Comptroller of Public Accounts to include, at least annually, notification of the right of a mother to breast-feed, and the prohibition against interference with that right, in the agency's tax policy e-newsletter.

The bill would allow a mother whose rights under this chapter's provisions were violated to bring a civil action against a person alleged to have violated those rights, and the court could provide injunctive relief and award compensatory damages of up to $500 for each day a violation occurs, attorney's fees, and court costs.

Local Government Impact

No fiscal implication to units of local government is anticipated.
