No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 12 of the Health and Safety Code to require the commissioner of the Department of State Health Services (DSHS) to appoint at least one representative from DSHS and the Department of Public Safety (DPS) to the Medical Advisory Board (MAB). The executive commissioner of the Health and Human Services Commission (HHSC) would be required to appoint a chair and a vice chair from among the members of the MAB and to annually review the MAB's rules and procedures. The bill would also require at least one member of a MAB panel to have medical expertise related to the medical condition of the applicant or license holder being considered by the panel. It is assumed that the provisions of the bill could be implemented using existing resources by DSHS, DPS, and HHSC. The bill would take effect September 1, 2019.
