No significant fiscal implication to the State is anticipated.
The bill would amend the Family Code to require that, before a court may issue a protective order by default due to a respondent's failure to appear in court, proof of service on the respondent must have been filed at least 48 hours before the hearing. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
