FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

March 10, 2019

TO:
Honorable Nicole Collier, Chair, House Committee on Criminal Jurisprudence

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB566 by White (Relating to the eligibility of certain criminal defendants for an order of nondisclosure of criminal history record information.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to provide an order of nondisclosure of a individual's criminal history record information if it is related to a charge that resulted in an acquittal or dismissal and that arose out of the same criminal episode of other charges for which the person was convicted or placed on deferred adjudication community supervision. Based on the analysis of the Office of Court Administration, the Department of Transportation, and the Department of Public Safety, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.

The bill would apply only to petitions filed on or after September 1, 2019.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
