No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedures to allow a defendant who is charged with a felony offense to waive the right to trial by jury without the consent of the state or the approval of the court, unless the punishment for the offense is fixed by law. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
