LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

May 10, 2019

TO:
Honorable Joan Huffman, Chair, Senate Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB770 by Davis, Sarah (Relating to the establishment of an electronic database for settlement agreements for certain suits involving minors or incapacitated persons; authorizing a fee.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to require the Office of Court Administration (OCA) to establish and maintain an electronic settlement agreement database for certain suits and to allow access to the database by certain parties. The bill authorizes the OCA to set and collect a fee of up to $50 per agreement to cover the cost of maintaining the agreements in the database.

Based on the analysis of the OCA and the Comptroller of Public Accounts, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Due to OCA's expectation of being able to absorb costs necessary to implement the provisions of the bill within existing resources, this analysis does not anticipate that any new fees authorized under the bill would be assessed and that any new revenue would be collected.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
