No significant fiscal implication to the State is anticipated.
The bill would amend the Business and Commerce Code to define an elderly individual as a person that is 65 years of age or older and increase the award amount for actual damages by up to three times the actual damages sustained in cases where an elderly individual is adversely affected by an anti-phishing violation defined in the code. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
