No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 438 of the Health and Safety Code by requiring a food service establishment to post consumer warning signs regarding peanut product preparation if the establishment prepares food that contains peanuts and has a designated space for eating. The bill would require warning signs to be posted in a conspicuous place.

The bill would require the Executive Commissioner of the Health and Human Services Commission (HHSC) to adopt rules to implement the provisions of the bill. HHSC indicates that the provisions of the bill would have no fiscal impact for the agency.

The Department of State Health Services (DSHS) would incorporate the provisions of the bill into standardized training of regional inspectors of food establishments. DSHS indicates that these activities could be accomplished with existing staff resources.
