LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

May 18, 2019

TO:
Honorable Joan Huffman, Chair, Senate Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB1078 by Oliverson (relating to waiving certain driver's license and handgun license fees for certain applicants who hold a certification in cardiopulmonary resuscitation.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The Department of Public Safety is required to implement a provision of this Act only if the legislature appropriates money specifically for that purpose. If the legislature does not appropriate money specifically for that purpose, the Department of Public Safety may, but is not required to, implement a provision of this Act using other appropriations available for that purpose.

The bill would waive certain fees for certain licenses applicants who hold a current certification in cardiopulmonary resuscitation issued by the American Heart Association, the American Red Cross, or another nationally recognized association.

The bill would require that DPS establish a record of the amount of the fees waived under the provisions of the bill that would otherwise be deposited to the credit of the Texas Mobility Fund. On or before the fifth day of every month, DPS would be required to, using available funds, remit to the Comptroller of Public Accounts for the deposit to the credit of the Texas Mobility Fund in an amount equal to the amount of the revenue loss as a result of the provisions of this bill. If DPS does not reimburse the Texas Mobility Fund, the bill would reduce, rescind, or repeal the dedication of a specific source or portion of revenue dedicated to the Texas Mobility Fund. Article 3, Section 49-k, of the Texas Constitution, specifies that while money in the Texas Mobility Fund is pledged for the payment of any outstanding debt obligations, the Legislature may not reduce, rescind, or repeal the dedication of a specific source or portion of revenue dedicated to the Texas Mobility Fund unless the Legislature by law dedicates a substitute or different source of revenue that is projected by the Comptroller to be of a value equal to or greater than the source or amount being reduced, rescinded, or repealed.

Local Government Impact
