No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code to impose additional appraisal disclosure requirements on an entity seeking to condemn under eminent domain and would require a court to dismiss a condemnation proceeding if the court finds that the condemning authority failed to comply with certain statutory requirements related to eminent domain.  The bill would also require certain fees to be paid to the owner of the property should a condemnation be dismissed.

According to the Office of Court Administration (OCA), no significant fiscal impact to the state court system is anticipated.

Local Government Impact

According to OCA, no significant impact to local courts is anticipated.

According to Harris County, the bill would have a potentially significant fiscal impact due to the increased risk of litigation and could cause project delays including the potential to have to start over on projects. However, the cost to the county cannot be determined at this time.

According to the Texas Municipal League, no significant fiscal impact to cities is anticipated.
