LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 1, 2019

TO:
Honorable Senfronia Thompson, Chair, House Committee on Public Health

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB1268 by Lucio III (Relating to dangerous wild animals; providing penalties; creating a criminal offense; authorizing a fee.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit owning, possessing, selling, transferring, breeding, or having custody or control of certain dangerous wild animals (DWAs), except under certain conditions. For those exceptions, the bill would require the Health and Human Services Commission to develop a DWA registration form and authorize the agency charge a registration fee in an amount to cover its related administrative costs. The bill would repeal provisions requiring DWAs to be registered through local animal control offices or county sheriffs.

The Health and Human Services Commission and Department of State Health Services indicate that the provisions of the bill could be absorbed using existing resources.

Local Government Impact

The Texas Association of Counties indicates that the bill could have fiscal impact on counties; however, the amount of any cost, and whether or not the registration fee the Health and Human Services Commission is authorized to establish would be sufficient to reimburse counties for any costs incurred, cannot be determined.
