The fiscal implications of the bill cannot be determined at this time.

The bill would amend the Insurance Code relating to denial of payment for preauthorized health care services. According to the Health and Human Services Commission (HHSC), the provisions of the bill would prevent the Office of Inspector General from recovering certain overpayments, which would result in significant increased costs in the Medicaid program. HHSC is unable to provide a specific estimate.

Based on information provided by the Texas Department of Insurance and Teacher Retirement System, this analysis assumes that the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
 
The bill would take effect September 1, 2019.

Local Government Impact

No fiscal implication to units of local government is anticipated.
