No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to expand the category of persons that may request a contested case hearing regarding a proposed concrete batch plan to include locations identified in the bill. The bill would make this change applicable to applications submitted to the Texas Commission on Environmental Quality (TCEQ) on or after the effective date of the bill. Based on the analysis of the TCEQ, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

The bill would take effect immediately upon receiving a two-thirds majority vote in each house; otherwise, the bill would take effect September 1,2019.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
