No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to allow a magistrate to deny bail to a person if the magistrate determines requiring bail would be insufficient to ensure the person's appearance in court or the safety of the alleged victim or the community.
The bill would apply to a person who is arrested on or after September 1, 2020.
Sections 1 and 2 of the bill would take effect December 1, 2019 upon the approval of a constitutional amendment to the Texas Constitution by the voters for the denial of bail to an accused person if necessary to ensure the person's appearance in court or the safety of the alleged victim or the community.
