FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

March 6, 2019

TO:
Honorable James White, Chair, House Committee on Corrections

FROM:

Legislative Budget Board

IN RE:
HB1389 by Thompson, Senfronia (Relating to the placement on community supervision, including deferred adjudication community supervision, of a defendant who is the primary caretaker of a child.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedures by requiring a court, upon the written motion of a defendant who is the primary caretaker of a child and who is charged with an offense eligible for community supervision or deferred adjudication community supervision, to consider the defendant's status as a primary caretaker before imposing a sentence. The court may defer further proceedings without entering an adjudication of guilt and may place the defendant on deferred adjudication community supervision or suspend the imposition of the sentence and place the defendant on community supervision. The Office of Court Administration and the Department of Criminal Justice indicate they could absorb the costs associated with the bill within its current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
