HB1456 by Dominguez (Relating to the appointment of counsel to represent an indigent person in certain criminal proceedings.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to permit an attorney appointed to represent an indigent person for the sole purpose of providing representation at the person's appearance before a magistrate in a hearing required to be held. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
 
The bill would take effect September 1, 2019.

Local Government Impact

The Texas Association of Counties anticipates a fiscal impact on those counties where attorneys are appointed as allowed by the bill. However, the extent of the impact cannot be determined at this time.
