The fiscal implications of the bill cannot be determined at this time as it is dependent on the number of defendants supervised for applicable misdemeanor offenses.
The bill would amend the Code of Criminal Procedure and the Government Code, as it relates to certain programs, including reentry and reintegration services and pretrial intervention programs, as outlined in the bill. The bill would also amend the funding formula used by the Community Justice Assistance Division (CJAD) to fund local Community Supervision and Corrections Departments (CSCD) and certain other entities that operate pretrial intervention programs to include funding for services provided to defendants supervised for certain misdemeanor offenses. Under current law, per capita funding for defendants supervised for a misdemeanor offense cannot exceed 182 days per defendant. The bill would remove the per capita funding limit for certain misdemeanor offenses. The bill would require CJAD to give certain CSCDs priority when awarding grants.
According to the Comptroller, the bill would have no revenue implications. The provisions of the bill related to per capita funding for CSCDs and for pretrial intervention programs could increase state costs. However, the costs cannot be determined at this time. The bill would take effect September 1, 2019.
Local Government Impact
The provisions of the bill may increase state funding to local CSCDs for pretrial intervention services; however, the fiscal impact cannot be determined at this time.
