IN RE:
HB1661 by Herrero (Relating to the prosecution of the criminal offense of continuous violence against the family.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure by providing that the offense of continuous violence against the family can be prosecuted in any county in which the defendant engaged in the continuous violence. The bill would also provide that it is not a defense to prosecution for continuous violence against the family that the conduct charged occurred in more than one county and that jury members are not required to unanimously agree on the county where each instance of the alleged conduct occurred. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
