No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 42 of the Human Resources Code to require the Health and Human Services Commission (HHSC), in collaboration with the Department of Family and Protective Services (DFPS), to collect, compile, and publish data related to incidents reported at licensed day-care centers. The bill would require HHSC to collect certain data for children four years of age and younger in a licensed day-care center, make this data available to certain researchers, and provide an annual report to the Legislature. The bill would also require HHSC to review the data collected and submit a report to the Legislature no later than January 1, 2021 that includes recommendations regarding modifications to the minimum standards by age group to enhance child safety.

The bill would take effect immediately upon receiving a two-thirds majority vote in each house. Otherwise, the bill would take effect September 1, 2019.

According to HHSC, there would be minimal costs to modify existing applications and to collect, analyze, and report the required data. LBB analysis of HHSC and DFPS assumes that the provisions of the bill could be absorbed using existing resources.
