No significant fiscal implication to the State is anticipated.
The bill would amend the Family Code and Penal Code to prohibit the prosecution or referral to juvenile court of a person younger than 18 years of age for the offense of prostitution where the person agrees to receive a fee from another to engage in sexual conduct. The bill would require the individuals to be referred to the Department of Family and Protective Services (DFPS) to receive services for at-risk youth.
The bill would take effect September 1, 2019.
DFPS estimates there would be a minimal cost associated with implementing the provisions of the bill.
The Office of Court Administration and the Juvenile Justice Department indicated they could absorb the costs associated with implementing the bill within their current resources.
