FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 26, 2019

TO:
Honorable Poncho Nevárez, Chair, House Committee on Homeland Security & Public Safety

FROM:

Legislative Budget Board

IN RE:
HB1791 by Krause (relating to the carrying of handguns by license holders on property owned or leased by a governmental entity.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

Under current law, a state agency or political subdivision of the state is prohibited from posting a sign prohibiting a licensed gun owner from entering the premises of the governmental entity with a handgun. The bill would add that a state agency or a political subdivision may not take any action, including posting notice, that would state or imply that a licensed gun owner who is carrying a handgun is prohibited from entering or remaining on the premises of the governmental entity unless carrying a handgun on the premises is prohibited pursuant to preexisting law.

The Health and Human Services Commission, Department of Motor Vehicles, Office of the Attorney General, Office of Court Administration, and Texas Workforce Commission indicate that the provisions of the bill could be absorbed using existing resources.

According to the Comptroller of Public Accounts, the fiscal implications of the bill for penalty revenue stemming from offenses cannot be determined. The number of offenses of noncompliance with prospective law is unknown.

Local Government Impact

Nueces County does not anticipate a fiscal impact to the County.
