HB1791 by Krause (Relating to the carrying of handguns by license holders on property owned or leased by a governmental entity.), As Introduced

No significant fiscal implication to the State is anticipated.

Under current law, a state agency or political subdivision of the state is prohibited from posting a sign prohibiting a licensed gun owner from entering the premises of the governmental entity with a handgun. The bill would add that a state agency or a political subdivision may not take any action that would prohibit or attempt to prohibit a licensed gun owner who is carrying a handgun from entering or remaining on the premises of the governmental entity, including posting notice, unless carrying a handgun on the premises is prohibited pursuant to preexisting law.

The Health and Human Services Commission, Department of Motor Vehicles, Office of the Attorney General, Office of Court Administration, and Texas Workforce Commission indicate that the provisions of the bill could be absorbed using existing resources.

According to the Comptroller of Public Accounts, the fiscal implications of the bill for penalty revenue stemming from offenses cannot be determined. The number of offenses of noncompliance with prospective law is unknown.

Local Government Impact

Nueces County does not anticipate a fiscal impact to the County.
