HB1849 by Klick (Relating to the possession and administration of epinephrine auto-injectors in day-care centers; limiting liability.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would create a new authorization and establish requirements for physicians, and physician assistances and advanced practice registered nurses who have been delegated prescribing authority, to prescribe epinephrine auto-injectors to specified day-care centers.

The bill would require the prescribing physician or other person to provide the day-care center with a standing order for the administration of the epinephrine auto-injector for a person experiencing anaphylaxis. The bill would provide specified immunity to civil and criminal liability and disciplinary action for the prescribing persons.

The Texas Medical Board (TMB), Health and Human Services Commission, and Board of Pharmacy do not anticipate a significant fiscal impact from the provisions of the bill. TMB indicates that it could receive complaints relating to prescribing and physician supervision of and delegation to providers, but it is unlikely there would be a significant number of these complaints.
