No significant fiscal implication to the State is anticipated.
The bill would amend the Estates Code by establishing a procedure for a court to appoint a descendant of a deceased patient of a state hospital as a personal representative for the purpose of obtaining the patient's medical records and limits a state hospital's liability for releasing a deceased patient's medical records to an appointed personal representative. Based on the analysis of the Office of Court Administration and the Health and Human Services Commission, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
