No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to require a judge, prior to accepting a plea of guilty or nolo contendere, to admonish the defendant, both orally for the record of the court and in writing, of potential consequences of such a plea if the defendant is not a citizen. The bill would require the court to receive, in writing, that the defendant understands the admonishment and is aware of the consequences of the plea.
Based on the analysis of the Office of Court Administration, no significant fiscal impact to the state is anticipated.
The bill would take effect September 1, 2019.
