No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code and the Local Government Code related to where a court may hold proceedings upon the occurrence of a disaster. The bill would affect district courts, county courts, justice courts, and municipal courts. The bill would extend the permissible number of days an order modifying or suspending procedures related to court proceedings may remain in effect from 30 to 90. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing  resources.

The bill would take immediate effect upon receiving a two-thirds vote in both houses; otherwise, the bill would take effect September 1, 2019.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
