No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code as it relates to the application of unlawful carrying of a handgun or possessing a handgun where prohibited. Under the provisions of the bill, certain retired judges and justices and certain other governmental officials would be added to the list of those who may exercise a defense to prosecution under current statute for certain weapons-related offenses.
The Office of Court Administration and the Texas Department of Criminal Justice do not anticipate any significant fiscal implications to the state resulting from the modifications outlined in the provisions of the bill. This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact to state correctional populations or the demand for state correctional resources.
