HB2069 by Wray (Relating to the foreclosure of a lien on real property of a decedent.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code to create a procedure for the sale of real property of a debtor who is deceased and is in default of a debt secured by a deed of trust or other contract lien on the property. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
 
The bill would take effect September 1, 2019.
