No significant fiscal implication to the State is anticipated.
The bill would amend the Agriculture Code to exempt from inspection and registration a commercial weighing or measuring device that is used exclusively to weigh food that is solid for immediate consumption and is not exempted from sales and use tax under Tax Code Sec. 151.314. The Department of Agriculture estimates that less than 2,000 such devices would be affected of the more than 144,000 weighing or measuring devices the department inspects annually. Based on the analysis of the Comptroller of Public Accounts, a minimal revenue loss would be realized due to the inspection and registration exemptions.
The bill would take immediate effect upon receiving a two-thirds vote in both houses; otherwise, the bill would take effect September 1, 2019.
