LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 16, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB2266 by Anchia (Relating to the repeal of certain provisions governing state and local enforcement of immigration laws and other provisions related to immigration law.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would repeal sections of the Code of Criminal Procedure, the Government Code, Local Government Code, and Penal Code relating to immigration. It is assumed that provisions of the bill could be implemented within existing resources.

This Act would take effect immediately if it receives a vote of two-thirds of all the members elected to each house. If this Act does not receive the vote necessary for immediate effect, this Act would take effect September 1, 2019.

Local Government Impact

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both. Lost revenue from reduced fines imposed and collected is not anticipated to have a significant fiscal impact.

The Office of Court Administration does not expect the repealed provisions of the bill to negatively impact the courts, and therefore no significant fiscal impact to the state court system is anticipated.
