Fiscal Analysis

The bill would amend the Occupations Code as it relates to the regulation of the practice of dental hygiene. Under the provisions of the bill, the Board of Dental Examiners (TSBDE) would be required to establish licensure and education requirements for dental hygienists to administer local anesthetic agents.

Methodology

Under the provisions of the bill, a dentist may delegate a dental hygienist to administer local anesthesia provided the dental hygienist has completed a certification examination and related educational course. In fiscal year 2019, the agency has 14,455 active dental hygienist licensees and estimates 775 new applicants each year.

TSBDE estimates that to expand and review the educational requirements for dental hygienists the agency would require an additional FTE for a License and Permit Specialist, $51,424 in fiscal year 2020, and $49,924 in each subsequent fiscal year.

This analysis assumes that any increased cost to TSBDE which is statutorily required to generate sufficient revenue to cover its costs of operation, would be offset by an increase in fee generated revenue.

Local Government Impact

No fiscal implication to units of local government is anticipated.
