No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to amend the instances in which a claimant in a suit involving a health care liability claim against a physician or health care provider for injury to or death of a patient resulting from emergency medical care may prove that the healthcare provided by the physician or health care provider departed from accepted standards of medical or health care.
Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
