No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to amend the instances in which a claimant in a suit involving a health care liability claim against a physician or health care provider for injury to or death of a patient resulting from emergency medical care may prove that the healthcare provided by the physician or health care provider departed from accepted standards of medical or health care.
The Office of Court Administration indicates that any costs associated with the bill could be absorbed within the agency's existing resources.
The bill would take effect September 1, 2019.
