No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to allow an attorney representing a witness to remain present in the grand jury room for the purpose of consultation with the witness and to require the state to disclose to the defense any mitigating information obtained as a result of a grand jury proceeding.
Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
