No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies code to provide that a person must be the prevailing party in order to recover attorney's fees from an individual or corporation in certain cases. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
