HB2449 by Springer (Relating to the acquisition of real property by the Texas Department of Transportation to protect a state highway.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 203.052 of the Transportation Code, relating to the authority of the Texas Transportation Commission to acquire property if it determines that the acquisition is necessary or convenient for certain state highway purposes. The bill would specify that an interest in real property necessary to protect a state highway includes real property adjacent to a state highway on which a building is maintained in an unsafe or unsanitary condition and obstructs or partially obstructs the highway.

Based on the information provided by the Texas Department of Transportation, it is assumed the acquisition of an interest in real property for the purposes authorized by the bill could be accomplished using the agency's existing highway planning and construction funds.
